1. Agreement and scope
These Terms are an agreement between you and ParkUp.nz Limited, called ParkUp in these Terms. They apply when you create an account or use ParkUp's website, community tools, listings, requests, messages or other services.
You also agree to the Community Standards. The Privacy Policy is a notice about personal information, not a waiver of your privacy rights. The Legal and Safety Guide and Responsible Camping Standards are guidance, not contracts.
ParkUp is request-to-book. A listing is not an invitation to arrive without approval. A host or organiser can approve or decline a request.
2. Accounts
- You must be 18 or older to hold an account.
- You must give accurate information and keep your login details secure.
- You are responsible for activity through your account unless you promptly tell us it has been compromised.
- An adult is responsible for any minor included in their stay, ride or event group.
- A minor cannot independently host, list, receive a payout or enter a storage or long-stay arrangement.
Legal basis: contracts with people under 18 have special enforceability rules. See the Contract and Commercial Law Act 2017.
3. ParkUp's role
ParkUp connects people and provides tools for listings, requests, messages and community activity. Stays are currently arranged directly between hosts and travellers. Rides are direct cost-sharing arrangements. Events are free to list and RSVP through ParkUp, with any organiser costs handled directly. Storage is arranged directly between the person offering the space and the person looking for one, and ParkUp charges nothing to use it.
If ParkUp later offers managed checkout for a feature, ParkUp will take an active role in that transaction. This may include managing the booking, collecting payment through a provider, applying disclosed fees, supporting complaints, pausing payouts and issuing or facilitating refunds. The Payments, Fees, Cancellations and Refunds Policy will apply only after an activation version is published and in effect.
ParkUp does not own, inspect, manage or insure every property, vehicle, event or stored item. We do not guarantee that a user, listing or arrangement is safe, suitable, lawful or accurately described. We remain responsible for ParkUp's own services and for rights that the law does not allow us to exclude.
4. Host, provider and organiser responsibilities
If you publish a listing or event, you must:
- have authority to offer the land, space, ride or event;
- describe it honestly, including price, access, hazards, facilities, restrictions and any work expected;
- check the council, planning, camping-ground, health and safety, fire, tax, insurance and licensing rules that apply;
- review requests and only approve arrangements you can safely and lawfully provide;
- respect approval-gated location and contact information;
- tell people in your listing if you are acting in trade.
A host acting in trade may owe consumer guarantees for the underlying service. ParkUp may also owe guarantees for its own services. One does not remove the other.

5. Traveller, seeker and attendee responsibilities
You must:
- wait for approval before arriving;
- give accurate dates, vehicle details, group information and relevant needs;
- follow the agreed access, safety, waste, fire, animal, noise and departure rules;
- pay or provide only what was clearly agreed;
- look after private information and not share an exact address without permission;
- leave promptly and take your property and waste with you.
6. Location and private details
For stays, a host shares the exact address and arrival details after approving a request. Do not use or share those details for another purpose. Event organisers control address sharing through the event page. Ride participants must agree how pickup and destination details will be shared.
Public map information is for discovery only. Do not rely on a map pin as permission to enter land or as a precise navigation instruction.
7. Charges and future managed payments
ParkUp is free to use. We do not charge to join, to list, to send a request, to be accepted, or to see a private address once a request is approved. No money moves through ParkUp for stays, rides, events or storage. Anything owed between two people is settled directly between them.
ParkUp does not currently offer managed checkout for stays, rides, events or storage. If it does, the total price and every mandatory component will be shown before confirmation. Components may include the underlying service, a host fee, a traveller connection fee, processing charges and tax. A connection fee may apply even where a stay is free, based on koha or involves work exchange.
No fee amount is fixed by this edition, and no fee is charged today. The activation version and the checkout will state any amount before you are asked to pay it. Any voluntary contribution will be separate, optional and unticked by default. Fuller detail sits in the Payments, Fees, Cancellations and Refunds Policy, which is a framework and is not in effect.
8. Content, messages and moderation
You keep ownership of content you post. You give ParkUp a non-exclusive, worldwide, royalty-free licence to host, copy, format and display that content only as reasonably needed to operate, secure, moderate and promote the ParkUp service. This licence ends when the content is deleted, except for lawful backups, evidence and material already shared outside ParkUp.
We may review reports and relevant content, restrict visibility, remove content, warn a user, limit features, suspend an account or close it where reasonably necessary for safety, law, fraud prevention, platform integrity or enforcement of these Terms. We will give notice and reasons where safe, lawful and practical, and provide a proportionate review path.

Reviews
After a stay or another arrangement, both people can review each other. Reviews are sealed when you write them. Neither of you sees the other's review until you have both written one, or until two weeks have passed, and then both are published together. This is so a review reflects what happened rather than a reply to what the other person said.
A published review is public and attached to your name. Write only what you experienced yourself, keep it honest and fair, and do not include an address, a gate code, a phone number or anyone else's personal details. A review is not the place to settle a dispute, and you cannot ask for a good review as a condition of anything.
Reviews are covered by the Community Standards and by the moderation rules above. We can remove a review that breaks those rules, is unlawful, or is used to harass, mislead or retaliate. We do not remove a review simply because it is unflattering. Once a review is published you cannot edit it, so take a moment before you send it.
9. Changes to these Terms
The current version of these Terms is always the one published on this page, with its version and effective date shown at the top. Every version and the date it took effect are listed in the change history, so you can see which Terms applied at any point in time. We may make minor clarifications from a stated effective date. For material changes to price, liability, privacy or ParkUp's role, we will give notice before the change takes effect, including by email where we hold your address.
Continuing to use ParkUp after the stated effective date means you accept the updated Terms. If you do not accept a change, you can stop using the affected service or ask us to close your account. A booking you have already confirmed keeps the price you agreed and the Terms that were in effect when it was confirmed, unless a lawful safety or legal requirement must apply. We will not rewrite a completed arrangement, and a change will not excuse conduct that was permitted when it occurred.
10. Consumer rights and liability
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
To the extent the law permits, each person remains responsible for their own acts, omissions and direct arrangement with another user. ParkUp is not responsible for loss caused solely by a user's unlawful conduct, inaccurate listing or failure to follow an agreement where ParkUp did not cause or contribute to that loss.
We do not ask you to indemnify ParkUp for every claim connected with use of the service. A court or tribunal can allocate responsibility according to the law and the facts.

11. Feature schedules
Stays
Stays are direct arrangements today. A request does not become an approved stay until the host confirms it. Hosts must accurately state the offered facilities, exchange and site rules. Travellers must not arrive before approval. The host shares the exact address and arrival details after approval.
A private-land stay is not automatically freedom camping. Hosts must check whether council rules, district plans, camping-ground regulations, public health, wastewater or fire rules apply. Certified self-containment rules for public freedom camping do not automatically apply to every private site, although a host can require certification as a property rule.

Long stays and land sharing
The legal status of a longer arrangement depends on the facts, including purpose, duration, exclusivity, facilities, the traveller's normal home and the kind of shelter. Calling it a stay, licence, land share or koha does not keep it outside tenancy law. Parties should use a clear written agreement and obtain independent advice before a longer or repeated arrangement.
ParkUp has not fixed a universal duration limit. This requires professional tenancy and property advice. Ordinary short-stay cancellation rules must not be used where tenancy law applies.

Work exchange
The parties must record the tasks, hours, expected standard and value before approval. Work must not be exploitative, unsafe or materially different from what was agreed. Accommodation exchanged for work can create employment, minimum wage, PAYE, GST, immigration, insurance and health and safety obligations. Calling someone a volunteer is not decisive.

Storage
Storage is operational. You can list a space, browse spaces, send a request, and accept or decline one. The private location is shared with the person seeking storage once the provider accepts their request.
ParkUp charges nothing for storage. There is no connection fee and no unlock fee, and ParkUp does not handle storage money. A listing can show a price, but that price is between the two of you and is paid directly. Agree what is owed, when and how before anything is dropped off.
Because ParkUp is not part of the arrangement, the two of you need to agree the terms yourselves before goods change hands. Cover who controls or possesses the goods, access times, care of the goods, prohibited goods, insurance, evidence of condition on arrival, what happens if goods are damaged or lost, what happens if payment stops, and how either of you ends the arrangement and collects or returns the goods. Put it in writing in your ParkUp messages so you both have a record.
ParkUp does not grant a provider a right to keep, sell or dispose of goods. If someone stops paying or stops collecting, you cannot simply keep or sell their belongings. Bailment, lien, abandoned-goods and Personal Property Securities Act questions are genuinely complicated, and we have not had these storage terms professionally reviewed, so get advice before you act on goods that are not yours.
Do not store anything you are not lawfully allowed to store. Firearms, ammunition, explosives, fireworks, drugs, hazardous or flammable substances, stolen goods and live animals do not belong in a private storage arrangement made through ParkUp.

Rides
Rides are direct cost-sharing arrangements. Any passenger contribution must be limited to vehicle running costs and must not pay for the driver's time or amount to a commercial fare. ParkUp does not currently process ride payments. Drivers remain responsible for a lawful vehicle, licence and insurance. Participants must agree safe pickup and destination details.
New Zealand transport rules may require ParkUp to hold a small passenger service licence as a facilitator. ParkUp must obtain professional transport advice before rides are materially promoted or monetised.

Events
Events are free to list and RSVP through ParkUp. Any organiser cost, koha or ticket arrangement is handled directly and must be clearly disclosed. The organiser controls address sharing through the event page.
Organisers are responsible for permissions, risk assessment, emergency access, first aid, traffic, food, alcohol, toilets, noise and fire requirements. Statutory health and safety duties cannot be transferred to ParkUp by agreement. A special alcohol licence may be required even where alcohol is linked to an entry fee, donation or koha.

12. Problems and disputes
Contact ParkUp first where it is reasonable to do so. We may ask for relevant evidence and help the parties communicate, but we are not the final legal decision-maker. You can still approach the Disputes Tribunal, Tenancy Tribunal, Privacy Commissioner, Commerce Commission, Netsafe, another regulator or a court where that forum has jurisdiction.
New Zealand law applies. The New Zealand courts have non-exclusive jurisdiction, subject to any tribunal or statutory forum that must hear the matter.
